Welcome to Apex Repacks Co. These Terms of Service (“Terms”) govern your access to and use of our website, products, and related services.

 

Throughout these Terms, “Apex Repacks Co.,” “Apex,” “we,” “us,” and “our” refer to Apex Repacks Co. By accessing our website, creating an account, purchasing a product, or otherwise using our services, you agree to these Terms.

 

If you do not agree with these Terms, please do not use our website or purchase our products.

 

1. Eligibility

 

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase products through our website.

 

By placing an order, you represent that you satisfy these requirements and that the information you provide is accurate and complete.

 

2. Apex Repacks and Randomized Products

 

Apex Repacks Co. offers curated sports trading card repacks. Repacks may contain a randomized selection of trading cards with contents varying from one package or box to another.

 

Depending on the particular product, potential contents may include graded cards, autographs, numbered parallels, rookies, inserts, case hits, memorabilia cards, chase cards, and other collectible trading cards.

 

By purchasing a repack, you understand and agree that:

• The specific contents of an unopened repack are not known to the purchaser in advance.

• Individual repacks may differ substantially in contents and market value.

• Purchasing a repack does not guarantee that you will receive a particular player, team, card, grade, autograph, parallel, insert, chase card, or stated type of hit unless the applicable product description expressly guarantees it.

• The value of the contents received may be higher or lower than the purchase price of the product.

• Not every purchaser will receive a featured or highest-value chase card.

• Past openings, customer results, promotional examples, and featured hits do not represent or guarantee the contents of future purchases.

 

Please review the applicable product description before purchasing, as individual Apex products may have different configurations, checklists, chase structures, or guarantees.

 

3. Card Values and Market Estimates

 

Trading cards are collectibles whose market values can change rapidly.

 

When Apex Repacks Co. provides an estimated value, comp, floor, ceiling, average, chase value, or other pricing reference, that information is provided as a good-faith estimate based on information reasonably available at the time the product was assembled or offered.

 

Pricing references may be based on recent sales, marketplace listings, pricing databases, comparable cards, or other market information.

 

A stated or estimated value is not a guarantee that a card can be sold for that amount.

 

Market prices may increase or decrease after a repack is produced or purchased, and Apex Repacks Co. is not responsible for subsequent changes in collectible value.

 

4. Orders and Payment

 

By submitting an order, you authorize us and our payment providers to charge the payment method provided for the total amount displayed during checkout.

 

You are responsible for providing accurate payment, billing, shipping, and contact information.

 

We reserve the right to reject, limit, hold, or cancel an order when reasonably necessary, including in cases involving suspected fraud, payment issues, pricing errors, inventory discrepancies, abuse of promotions, unusually large quantities, or other suspicious activity.

 

If we cancel an order after payment has been successfully processed and before the product has been fulfilled, the applicable purchase amount will generally be refunded.

 

5. Pricing and Product Availability

 

Prices, product configurations, promotions, available quantities, and inventory may change without notice.

 

Many Apex products are produced in limited quantities. Adding an item to a shopping cart does not necessarily reserve that item unless otherwise indicated by our website.

 

We make reasonable efforts to ensure product information is accurate but reserve the right to correct genuine typographical, pricing, inventory, or technical errors.

 

6. Final Sales, Returns and Cancellations

 

Because of the randomized and collectible nature of our products, sales of repacks are final once the product has been opened, revealed, or otherwise fulfilled, except where a return or refund is required by applicable law.

 

We generally cannot accept returns because a purchaser is dissatisfied with the particular card received, the card's subsequent market value, or because the purchaser did not receive a desired chase card.

 

Orders that have not yet been processed or shipped may be eligible for cancellation at our discretion.

 

If you receive an incorrect product or believe your order was damaged before delivery, please contact us promptly so we can review the situation.

 

Any additional refund, return, or cancellation terms displayed on a particular product page will also apply to that purchase.

 

7. Live Breaks and Streamed Openings

 

Some Apex products may be opened, revealed, or sold during live streams or through third-party marketplaces.

 

When purchasing a product designated to be opened live, you authorize the applicable product to be opened on your behalf during the stream.

 

Once the product has been opened or its contents revealed, the transaction generally cannot be canceled based on the outcome of the opening.

 

Participation through a third-party marketplace may also be subject to that platform's separate terms, policies, payment procedures, and buyer protections.

 

8. Shipping and Delivery

 

Customers are responsible for providing a complete and accurate shipping address.

 

Once an order has been transferred to a shipping carrier, delivery times may be affected by circumstances outside our control.

 

Apex Repacks Co. is not responsible for delays caused solely by shipping carriers, weather events, incorrect customer-provided addresses, or other circumstances outside our reasonable control.

 

If tracking indicates a delivery problem, loss, or damage, please contact us so we can assist in reviewing the shipment and, when appropriate, work with the carrier.

 

9. Product Condition and Grading

 

Trading cards may exhibit normal manufacturing or condition variations.

 

For professionally graded cards, the grade and certification are determined by the applicable third-party grading company, not Apex Repacks Co.

 

Apex does not independently guarantee that a third-party grade will remain unchanged if a card is subsequently reviewed, regraded, crossed to another grading service, or removed from its holder.

 

Unless expressly stated otherwise, purchasing an ungraded card does not guarantee any particular future grading result.

 

10. Intellectual Property

 

The Apex Repacks Co. name, logos, graphics, product designs, packaging, photographs, website content, written materials, branding, and other original materials are owned by Apex Repacks Co. or used with appropriate authorization.

 

You may not reproduce, modify, distribute, commercially exploit, or represent our intellectual property as your own without prior written permission.

 

Third-party trademarks, player names, league names, card brands, grading companies, and other third-party intellectual property remain the property of their respective owners.

 

11. Acceptable Use

 

You may not use our website or services to engage in unlawful activity, interfere with website security or operation, attempt unauthorized access to systems or accounts, submit fraudulent transactions, misuse promotions, impersonate another person, or use automated systems to improperly scrape or disrupt our services.

 

We reserve the right to restrict access, cancel orders, or take other reasonable action in response to fraudulent, abusive, or unlawful activity.

 

12. Disclaimer of Warranties

 

To the fullest extent permitted by applicable law, our website and products are provided on an “as is” and “as available” basis except for warranties or representations expressly provided by Apex Repacks Co.

 

We do not guarantee future trading-card values, investment performance, resale opportunities, grading results, or the receipt of any particular randomized card except where expressly stated in the applicable product description.

 

Trading cards should be purchased as collectibles and not based on an expectation of financial return.

 

13. Limitation of Liability

 

To the fullest extent permitted by applicable law, Apex Repacks Co. will not be responsible for indirect, incidental, special, exemplary, or consequential losses arising from the use of our website or products, including lost profits or changes in the resale or collectible value of trading cards.

 

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

 

14. Fraud, Payment Disputes and Chargebacks

 

If you believe there is an issue with an order, we encourage you to contact us first so we have an opportunity to investigate and resolve the matter.

 

Fraudulent chargebacks, false claims of non-delivery, payment disputes initiated after receiving or revealing a product, or other intentional misuse of payment protections may result in suspension of future purchasing privileges and may be contested using available transaction, shipping, delivery, and fulfillment records.

 

This section does not limit any legitimate rights you may have through your payment provider or applicable law.

 

15. Suspension or Termination

 

We may restrict or terminate access to our website or services when reasonably necessary due to violations of these Terms, suspected fraud, unlawful conduct, abuse, threats, or activity that may harm Apex Repacks Co., our customers, or our services.

 

16. Governing Law

 

These Terms and disputes relating to them will be governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles, except where applicable law requires otherwise.

 

17. Changes to These Terms

 

We may revise these Terms periodically to reflect changes to our products, website, business practices, or legal requirements.

 

The updated Terms will be posted on our website with a revised “Last Updated” date.

 

Your continued use of our website following an update constitutes acceptance of the revised Terms to the extent permitted by law.
